Roy Burrell Attempts To Ban Blogging

Of course, his goal is only to prevent “cyber-bullying,” but the proposed law would include pretty much any kind of electronic insult:

House Bill 1259 by state Rep. Roy Burrell, D-Shreveport, would criminalize the transmission of electronic textual, visual, written or oral communication that is intended to “coerce, abuse, torment, intimidate, frighten, harass, embarrass or cause emotional distress” to anyone under the age of 17.

That’s probably 99% of the text messages my students send to each other. This is ridiculously overbroad. I don’t want to trust public officials to only prosecute “really bad” cases. If this is going to be a law, write it so narrowly that public officials can’t bring anything but serious cases.

Though, as I explained here, I don’t think these laws are a good idea no matter how written. Is it a good thing that kids are that jerky towards each other? Of course not. But in the end, these are just words. And I don’t want to make someone a criminal for mere words.
